The following terms and conditions (the "Terms") apply to the purchase and use of digital Jomashop gift cards (collectively, "Gift Cards"). Your purchase and use of the Gift Cards constitute your agreement to follow and be bound by these Terms. Gift Cards are issued by Jomashop, Inc.

Redemption & Use
Gift Cards are redeemable at Jomashop.com, on the Jomashop apps. Gift Cards may not be returned or applied as payment on any account. Gift Cards may not be redeemed for cash except as required by law.

Returns
If a Gift Card is used to place an order and items from that order are returned, generally, refunds are credited back to that original Gift Card.

Expiration & Fees

Title to and risk of loss for Gift Cards pass to the purchaser upon sale. Please treat your Gift Card like cash and safeguard it accordingly. Compliance with Laws
By purchasing or using a Gift Card, you are certifying and representing to Jomashop that the activities in connection with which the Gift Card will be used will comply with these Terms and all applicable laws, rules and regulations, and that the Gift Card will not be used in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers or Jomashop. In addition, you agree to defend and indemnify Jomashop, Inc. and its subsidiaries and affiliates from and against any claims, expenses or liabilities made against or incurred by any of them in connection with your use of the Gift Card or violation of any of these Terms.

Limitation of Liability
GIFT CARDS ARE PROVIDED ON AN 'AS IS' BASIS, AND JOMASHOP DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THE GIFT CARDS, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. JOMASHOP AND ITS AFFILIATES DO NOT REPRESENT OR WARRANT THAT YOUR GIFT CARD WILL ALWAYS BE ACCESSIBLE OR ACCEPTED. JOMASHOP AND ITS AFFILIATES AND ITS VENDORS SHALL NOT BE LIABLE TO ANY PERSON OR ENTITY FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE (WHETHER ACTUAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR OTHERWISE), INJURY, CLAIM OR LIABILITY OF ANY KIND OR CHARACTER WHATSOEVER BASED UPON OR RESULTING FROM THE GIFT CARDS OR USE OF SUCH GIFT CARDS. IN THE EVENT THAT JOMASHOP OR ITS AFFILIATES ARE FOUND LIABLE TO YOU, YOUR SOLE REMEDY WILL BE TO RECOVER ACTUAL AND DIRECT DAMAGES WHICH SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR GIFT CARD. Dispute Resolution & Applicable Law
Any dispute or claim relating in any way to Gift Cards will be resolved in accordance with the dispute resolution terms in the Jomashop Terms and Conditions.

THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA OR JAMS RULES AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR JOMASHOP WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.

Applicable Law
The law applicable to the interpretation and construction of these Terms shall be the Federal Arbitration Act, applicable federal laws, and the laws of the State of New York, USA, without regard to principles of conflict of laws, but subject to the Federal Arbitration Act and other federal law relating to the arbitrability of claims. You agree that all matters relating to the Gift Cards or use of the Gift Cards, including all disputes, will be governed by the laws of the United States and by the laws of the State of New York.

General Terms
We reserve the right to make changes to these Terms at any time and will provide notice of such changes if or as required by law. If any of these conditions shall be deemed invalid, void or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Official Jomashop.com Customer Survey Sweepstakes Rules

1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. The Jomashop.com Customer Survey Sweepstakes (the "Sweepstakes") is void where prohibited by law and is sponsored by Jomashop.com, 140A 58th Street, Suite 6N - 6th Floor Brooklyn, NY 11220 ("Jomashop.com" or the "Sponsor").

2. Entry Methods Enter the Sweepstakes by doing any one the following: 1) complete one or more of the following https://public.getmetasurvey.com/survey/65cf783bff8b680012d18632 via its designated link and you will be automatically entered one time for each survey you complete.

3. Entry Period Entries must be received by Sponsor between 12:01 a.m. (E.D.T or E.S.T) on the first day of the start month of each quarter (January, April, July, October), and 11:59 p.m. (E.D.T. or E.S.T) on the last day of the end month of each quarter (March, June, September, December) to be eligible for entry into the Sweepstakes (the "Entry Period"). Mail-in entries must be postmarked by the last day of the end month of each quarter and received by 11:59 p.m. (E.D.T. or E.S.T) on the sixth day of the following month. Sponsor's computer network time is the official clock for the Sweepstakes. Entries received outside the Entry Period will be carried over into the next quarter's Sweepstakes.

4. Winner Selection and Identification/Prizes/Odds One (1) prize winner will be selected in a random drawing from among all eligible entries. The prize winner will receive a Jomashop.com Gift-Card pre-valued in the amount of Two Hundred and Fifty ($250.00) Dollars. No cash or other substitutions will be offered. All federal, state, provincial and local taxes are the sole responsibility of the winner. The drawing will be conducted by Sponsor electronically on or about the fifteenth (15th) day of the month following the end of a quarter. For example, for the first quarter (January - March), the drawing would be conducted around April 15th. Winners will be identified by the e-mail account associated with an online entrant, or the name and mailing address stated on an entry postcard. For these purposes, an e-mail account holder shall mean the natural person assigned to such e-mail account by the internet access or online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any issues regarding the identity of a winner shall be resolved by Sponsor in its sole discretion. Winners will be notified and will receive their prize via mail to the name and address in Sponsor's records associated with the e-mail account from which such entry was received if entry was done electronically, or via mail to the name and address provided with the entry if entry was via mail. If, for any reason, the Winner cannot be contacted within one (1) week of selection after reasonable attempts by Sponsor, an alternate Winner will be selected from the remaining eligible entries. 5. Eligible Participants The Sweepstakes is only open to residents of the United States who are at least thirteen (13) years of age on their entry date and is not open to employees of Sponsor, their immediate family, any person domiciled with such employees, or any affiliates or subsidiaries of Sponsor.

6. Entry Ownership/Entrant Agreements Each entrant (and entrant's parent/legal guardian if entrant is a minor) agrees: (a) to be bound by these Official Jomashop.com Customer Survey Sweepstakes Rules; (b) that any claims related to the Sweepstakes shall be resolved individually without resort to any form of class action and that awards, shall be limited to actual out-of-pocket costs incurred in entering the Sweepstakes, and shall not include incidental or consequential damages or attorneys fees; (c) and that any actual or perceived ambiguities in these rules shall be interpreted by Sponsor in its sole discretion.

7. Limitation of Liability Sponsor is not responsible for incomplete entries or for failure to receive entries due to technical failures or human error of any kind. Winner agrees that Sponsor will have no responsibility for losses or damage of any kind resulting from the acceptance, possession, or use of the prize. 8. Sponsor Modification/Cancellation Rights Sponsor may modify or discontinue the Sweepstakes at any time and may disqualify from the Sweepstakes any person it determines, in its sole discretion, to have attempted to or actually tampered with or otherwise abused any aspect of the Sweepstakes.

9. Choice of Law/ Venue Entrants agree that in the unlikely event a dispute arises in connection with this Sweepstakes, it will be governed by the laws of the State of New York and heard exclusively in a court of applicable jurisdiction in the County and State of New York irrespective of any choice of law provisions to the contrary.
