Jomashop Loyalty Program Overview

Joma Cash Loyalty Program
Joma Cash is a promotional loyalty credit (also referred to as promotional cashback) issued by Jomashop at no additional cost to you. It has no cash or monetary value unless redeemed on a qualifying purchase before its expiration date. Joma Cash is non-transferable, may only be used as a credit toward future eligible purchases on Jomashop, and cannot be redeemed for cash or exchanged for any monetary amount. It is provided solely for promotional purposes without any money or other value given in exchange.

Eligibility and Earning Joma Cash
Joma Cash is awarded exclusively for qualifying purchases made through the Jomashop Android or iOS mobile app. Joma Cash is currently earned at 1¢ per $1 spent on qualifying items in the Fragrances, Skincare, and Makeup departments via the Jomashop mobile app only. Eligible departments, earning rates, and promotional multipliers are subject to change at any time. Joma Cash is credited to your account once your qualifying order ships.

Viewing and Redeeming
You may view your Joma Cash balance in your account and apply it at checkout on eligible purchases. Joma Cash may be combined with coupons unless otherwise stated.

Expiration and Activity
Joma Cash expires after 60 days without activity. Activity means placing a qualifying order through the Jomashop mobile app. Jomashop reserves the right to modify the inactivity/expiration period or any other program rules at any time.

Returns and Adjustments
If you return or cancel an order on which Joma Cash was earned, the corresponding Joma Cash will be revoked. If you used Joma Cash on an order that is later returned or canceled, the value of the Joma Cash used will be deducted from your refund.

Promotional Nature and No Monetary Value
Joma Cash is a promotional incentive issued without separate consideration and does not constitute a gift certificate, stored-value card, or money under New York law or any other jurisdiction. As such, it is exempt from certain gift card statutes that apply only to purchased gift certificates.

Revocation and Modification
Jomashop reserves the right to modify, suspend, or terminate the Joma Cash program, including earning rates, redemption rules, or any Joma Cash balance, at any time in its sole discretion (including in cases of fraud, abuse, or violation of these terms).

Limitation of Liability
To the maximum extent permitted by law, Jomashop shall not be liable for any loss, expiration, or reduction of Joma Cash, or for any indirect, incidental, or consequential damages arising from the program.

Changes to Program Terms
We may update these Joma Cash terms at any time. Your continued use of Joma Cash or participation in the program after changes constitutes your acceptance of the revised terms.

Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to the Joma Cash Loyalty Program, these terms, your Joma Cash balance, or your use of the program (whether based in contract, tort, statute, or otherwise) shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in New York County, New York, in English, before a single arbitrator. You and Jomashop agree to waive any right to a jury trial or to participate in a class action lawsuit, class arbitration, or representative proceeding. This arbitration agreement is governed by the Federal Arbitration Act. You may opt out of this arbitration agreement by sending a written notice to Asher Gulko at legal-optout@jomashop.io within thirty (30) days of first accepting these terms or participating in the Joma Cash program.

Governing Law
These Joma Cash terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.
